Terms for using our website and services
These Terms and Conditions explain the general rules for using the Mufti Digital Media website and engaging our digital services.
They apply to website visitors, service enquirers, clients and any person or organization communicating with Mufti Digital Media for professional digital support.
1. Introduction
These Terms and Conditions govern the use of the Mufti Digital Media website and the engagement of our digital services. By accessing our website, contacting us or requesting our services, you agree to these terms.
2. About Mufti Digital Media
Mufti Digital Media provides software development, website development, AI automation, healthcare technology, branding, consulting, digital marketing and graphic design services to clients in Kenya and selected international markets.
3. Website Use
You agree to use this website for lawful purposes only. You should not attempt to damage, misuse, interfere with or gain unauthorized access to any part of the website, its systems or related digital infrastructure.
4. Service Enquiries
Submitting an enquiry through our website, email, WhatsApp or phone does not automatically create a service agreement. A formal engagement begins after scope, pricing, timelines and payment terms have been discussed and agreed.
5. Proposals and Quotations
Any proposal, quotation or estimate provided by Mufti Digital Media is based on the information available at the time. Prices, timelines and deliverables may change if the project scope changes or additional requirements are introduced.
6. Project Scope
Project deliverables will be guided by the agreed scope of work. Any work outside the approved scope may require additional cost, revised timelines or a separate agreement.
7. Client Responsibilities
Clients are responsible for providing accurate information, content, approvals, access credentials, brand materials and feedback required to complete the project. Delays in providing these items may affect project timelines.
8. Payments
Payment terms will be communicated in the proposal, invoice or service agreement. Mufti Digital Media may require deposits, milestone payments or full payment before starting or delivering certain services.
9. Revisions and Approvals
Revisions are handled according to the agreed project scope. Once a design, website, document, campaign or system feature is approved, further changes may be treated as additional work.
10. Intellectual Property
Final project deliverables may be transferred to the client after full payment, unless otherwise agreed. Mufti Digital Media may retain ownership of internal tools, frameworks, templates, reusable code structures and processes used to deliver the work.
11. Third-Party Services
Some projects may require third-party services such as hosting, domains, plugins, APIs, payment gateways, analytics tools, email platforms or advertising platforms. These services are subject to their own terms and costs.
12. Digital Marketing Results
Mufti Digital Media works to improve visibility, communication, campaigns and digital performance. However, we do not guarantee specific sales, traffic, rankings, leads or revenue because results depend on many external factors.
13. Website and Software Support
Maintenance, updates, bug fixes, hosting support and ongoing software support are provided only where included in the agreement, package or maintenance plan.
14. Limitation of Liability
Mufti Digital Media will not be liable for indirect losses, business interruption, loss of profit, third-party platform failures, hosting issues or delays caused by incomplete client information, external providers or circumstances beyond our control.
15. Confidentiality
Mufti Digital Media treats client project information with care. Clients are also expected to keep confidential any private business information, proposals, credentials or technical details shared during project delivery.
16. Policy Updates
Mufti Digital Media may update these Terms and Conditions from time to time. The updated version will be posted on this page with the latest revision date.
17. Contact Us
For questions about these Terms and Conditions, you may contact Mufti Digital Media through our official email, phone number, WhatsApp or contact page.
These Terms and Conditions are provided for general website and service communication purposes. For formal contracts, the specific project proposal, invoice, service agreement or signed document will guide the engagement.
